Welcome to ToolXNow. These Terms of Service ("Terms") govern your access to and use of our website, applications, and related services (collectively, the "Service"). By creating an account, browsing listings, renting or purchasing tools, or otherwise using the Service, you agree to be bound by these Terms.

Eligibility and accounts

You must be able to form a legally binding contract in your jurisdiction to use the Service. You are responsible for providing accurate information and for maintaining the confidentiality of your login credentials and for all activity under your account.

Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not misuse the platform, interfere with other users, attempt unauthorized access to systems or data, or use automated means to scrape or overload the Service except as expressly permitted.

Listings, rentals, and sales

• Rental rates and sale prices are as shown on listings, subject to availability and any taxes or fees disclosed at checkout.
• You are responsible for reading listing details, condition descriptions, and pickup or delivery terms before committing to a transaction.
• For rentals, you are responsible for proper use, care, and timely return of tools. Late returns, loss, or damage may result in additional charges as described in the listing or checkout flow.
• Sellers and renters are expected to act in good faith. Disputes between users should first be addressed through communication; ToolXNow may offer support channels but is not obligated to mediate every dispute.

Third parties

The Service may integrate with third-party providers (for example authentication, payments, or shipping). Your use of those services may be subject to separate terms and privacy policies. ToolXNow is not responsible for third-party services we do not control.

Intellectual property

The Service, including its design, branding, and content (excluding user-generated content), is owned by ToolXNow or its licensors. You receive a limited, non-exclusive license to use the Service for its intended purpose. You retain rights to content you submit, and you grant ToolXNow a license to host, display, and use that content to operate the marketplace.

Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, ToolXNow and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of tools, listings, or the Service. Our aggregate liability for claims relating to the Service is limited to the greater of amounts you paid to ToolXNow in the twelve months preceding the claim or one hundred dollars (US), where permitted by law.

Indemnity

You agree to indemnify and hold harmless ToolXNow from claims, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your listings or transactions, or your violation of these Terms or applicable law.

Changes to these Terms

We may modify these Terms at any time. We will post the updated Terms on this page and update the "Last updated" date. If changes are material, we may provide additional notice as appropriate. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by the laws applicable in the jurisdiction where ToolXNow operates its primary business, without regard to conflict of law principles, except where mandatory consumer protections apply in your country of residence.
